Laser Diffusers: The story
so far (as at 16th June 2006). While laser
diffusers are frowned upon by the police they
are not illegal at this moment in time, however
if the police could prove primary intent that
the device is being used as a way to confuse
a laser gun and to avoid a speeding conviction
you may be at risk. They will be looking for
a conviction of obstructing a police officer
or perverting the course of justice.
The problem for the police
is that this is very difficult to prove especially
if the primary function of the device is as
a garage door opener or as a parking sensor.
Radar/Laser Detectors: These
alert you when there's a radar or speed trap
coming up, they'll work with mobile traps
and Gatso's and have been legal since a high
court ruling in 1998.
GPS Based Systems: These
use satellites to pinpoint your location and
check it against known speed trap sites so
they only work with permanent speed traps.
They are not illegal and most plug in to the
internet to update.
Advice for Offenders
Check the alleged speed and time of the
offence, the police can make mistakes.
If you are summoned for a serious speeding
offence caught on camera, you may have a
right to appeal if you did not receive notification
within 14 days.
If you are caught only a few mph over,
ask for a calibration certificate for the
machine that caught you. Gatsos must be
checked anually.
If you decide to appeal, ask to see police
evidence, they are not allowed to produce
photocopies or digitally advanced photographs.
